The use of AI Tools within the Service (by activating them in the settings) constitutes the User's full and unconditional agreement to these Additional Terms of Use: AI Functionality. The User can disable individual AI-based functions.
The User understands that AI Tools independently analyze provided data to generate structured results. Operating parameters, language of generation, and analysis logic are determined by the current settings and technical capabilities of the Service.
1.1. The results obtained using AI Tools are not final and are subject to verification by the User before making decisions; such data should be assessed in conjunction with other relevant information.
1.2. Within the meaning of Regulation (EU) 2024/1689 (AI Act), the User acts as a Deployer and independently bears the obligations imposed by law on deployers of high-risk AI systems, in particular regarding informing candidates/employees, ensuring human supervision and assessing the impact on the rights of individuals.
2.1. The User retains full control and bears sole responsibility for:
a) Reviewing, editing, adding, or deleting any criteria generated by AI to ensure compliance with actual professional requirements.
b) Compliance of the selected criteria with internal company policies, legal requirements, and non-discrimination principles. The User undertakes to delete any criteria that may lead to the restriction of persons' rights based on characteristics unrelated to professional qualities.
c) Setting evaluation parameters and final approval of the criteria list before launching scoring algorithms.
d) Interpreting the results generated by AI and making all final decisions.
2.2. The User undertakes not to use AI Tools for:
2.3. The User bears full responsibility for any claims, lawsuits, or complaints from candidates or government authorities arising from the User's use of AI results (in particular, regarding discrimination in hiring or privacy violations).
3.1. Results generated by AI Tools are recorded in the System based on settings current at the time of the request. Any changes to input data or settings by the User do not automatically change previously created results.
3.2. Re-generation or recalculation of results (e.g., re-evaluating candidates based on new criteria) is carried out exclusively at the initiative and after the performance of relevant manual actions by the User.
4.1. To ensure the operation of AI, text data and depersonalized information content (without direct transfer of any personal/contact information) may be transferred for processing to verified subprocessors — providers of AI models including OpenAI and Gemini.
4.2. The Service guarantees that User data transferred for analysis to the AI Tool is not used for training public artificial intelligence models of third parties.
4.3. The User owns the generated results within their account (Content), however, algorithms, system instructions (prompts), and evaluation methodologies remain the intellectual property of HURMA.
5.1. The Service does not guarantee the absolute accuracy or objectivity of results generated by AI. The User is aware of the possibility of AI models generating/providing incorrect information and undertakes to independently verify critical data.
5.2. The result of the AI Tool's operation is merely a mathematical prediction of suitability and a recommendation. The final decision regarding the use of results, recommendations, and proposals received from the AI Tool is made exclusively by the User (a human).
5.3. The results obtained using AI tools are probabilistic in nature, and therefore their accuracy, reliability and suitability for the User's purposes cannot be guaranteed. In this regard, the User is obliged to ensure that all results are verified in order to confirm their suitability for specific purposes of use.
5.4. The AI tool does not provide for automated decision-making, and cannot be used as the sole basis for decision-making.
5.5. Disclaimer: The Service Provider shall not be liable for any direct or indirect damages (including claims regarding discrimination, erroneous results, etc.) arising from the use of AI functions or decisions made based on the use of proposals provided by the AI Tool.
